The International Traffic in Arms Regulations (ITAR) controls the export and import of defense articles, defense services, and related technical data listed on the United States Munitions List (USML). Administered by the State Department's DDTC, ITAR ensures that sensitive military technologies are transferred only to authorized end-users and destinations.
Any company manufacturing, exporting, or brokering defense articles must be registered with DDTC and comply with all licensing requirements before any transfer occurs.
The Export Administration Regulations (EAR) govern the export of dual-use items-commercial goods and technologies that have both civilian and potential military applications. These items are listed on the Commerce Control List (CCL) and administered by the Bureau of Industry and Security (BIS).
EAR compliance is essential for companies dealing in electronics, software, telecommunications, and other technologies that may have defense or intelligence applications beyond their commercial purpose.
ITAR and EAR form complementary pillars of the U.S. export control regime. Items are classified under either the USML (ITAR) or CCL (EAR), and the appropriate regulations apply based on that classification.
